Duke Seeks Court Affirmation For Terre Haute Power Lines

Duke Energy is asking a Vigo County court to affirm its right to use easements on 70 property owners' land to construct new power lines.

The company plans to put in 11 miles of new power lines from its Dresser substation to the Wabash River Generating Station in West Terre Haute.

Four coal-burning units at the Wabash River facility are scheduled to be shut down next year an effort to comply with EPA regulations. The new lines will replace the power those units generate so power will not be lost to residents in West Central Indiana, which Duke is required to maintain under federal law.

The 70 property owners include those affected by the southern part of the route. Duke Energy officials say they previously obtained the easements they plan to use but some property owners had questions about whether the easements were valid. A court order would reiterate that those easements can be used.

"We're confident that the easements are valid and enforceable, but in order to ensure those who might have questions about that, we're asking the court to review all the documents and issue what's called a declaratory judgment," Duke Energy spokesman Lew Middleton says, adding that the court order would help the company get the power lines up and running before the Wabash River units are retired.

If something has been built on the easement that could interfere with construction, the company plans consult with property owners to try to work around it but some structures might need to be moved.

Duke Energy is also in communication with property owners who would be along the northern section of the power line route. The company is seeking to obtain new easements on those properties.

Construction of the power lines is expected to begin in the second half of 2015.

Property owners will be notified of the court filing and have 23 days to respond.
