A ruling from a state agency could mean an almost yearlong battle over the utilities of a multi-million dollar development in Brown County is closer to resolution.
The Indiana Utility Regulatory Commission approved the town of Nashville’s move to provide utilities to a property under development by Quaff On! Brewing Company this week. The town has been involved in a legal battle with another utility provider, Brown County Water Utilities over the property.
Quaff On!’s development, Hard Truth Hills, is located on a property known as Firecracker Hill, right outside Nashville. The owners signed a contract with the town to provide utilities last May. The town also annexed that property. Hard Truth Hills opened the first phase of its project in December.
The two entities are also involved in a federal lawsuit over the issue. Brown County Water Utilities filed the lawsuit in June of last year and maintains the property is within its service area.
Both Brown County Water Utilities and the Town of Nashville declined to comment due to pending litigation.
