For the second time, U.S. District Judge Sarah Evans Barker has rejected a motion for dismissal of the Secretary of State‘s lawsuit.

For the second time, U.S. District Judge Sarah Evans Barker has rejected a motion for dismissal of the Secretary of State‘s lawsuit seeking to recover losses allegedly sustained by schools through securities violations by the Indiana State Teachers Association and the National Education Association.

The teachers unions are accused of commingling and misusing funds they had promised to invest with a guaranteed rate of return.

The Securities Division believes ISTA unlawfully took money from its members‘ schools when it offered securities in the form of a health plan. A trial is scheduled for October 28.
