A judge ruled Thursday that INDOT does have a right to be on the land, even though it is owned by a private citizen.
Governor Daniels said public servants deserve the extra money after reining in the state budget and coming up with a larger than expected surplus.
The plan calls for more domestic oil production, increased fuel efficiency in vehicles, and incentives for energy performance in buildings.
Wallace says his priority now is to work on increasing his name recognition in the state.
