The ACLU is arguing the Department of Corrections does not provide adequate services for mentally ill people who come under their watch.
In the ruling, the judge said that could encompass those who haven’t broken the law, rendering it problematic.
While the state argues it's merely trying to enact and enforce immigration laws, the ACLU of Indiana thinks the state is overstepping its bounds.
The Indiana ACLU says immigration is a federal, not state matter.
The jail was under supervision for a lawsuit for overcrowding in 1972. But some fear the same conditions could occur at other local jails.
