A fact finding hearing in the case is scheduled for next week in Morgan County

The 11-year-old boy accused in the murder of his 6-year-old brother will be tried in juvenile court. Morgan County Prosecutor Steve Sonnega said many factors went into the decision, including the possibility of rehabilitation, and he feels the boy is not beyond being rehabilitated. Sonnega said they also looked at the boy‘s age maturity and cognitive ability, along with his situation at home.

Sonnega said he is looking into the possibility of charges against the mother concerning storage of the gun, but no decision has been made. 6-year-old Andrew Frye was fatally shot June 30 in Martinsville. The 11-year-old is being held at the Johnson County Juvenile Detention Facility. A fact-finding hearing in the case is scheduled for next week.
