IU Prof Says Planned Parenthood Defunding Illegal

According to an IU legal expert, the state cannot remove federal funds from women's health services.

An IU law professor says there is some strong legal ground to support Planned Parenthood of Indiana’s case against the state. The organization is seeking an injunction against the enforcement of a state law that would deny funding to organizations that offer abortion services.

Dr. David Orentlicher with the IU School of Law in Indianapolis says the state has the right to withhold state money, but doesn‘t have the authority to withhold federal funds designated for women‘s health services.

Orentlicher says the state‘s block of federal funds is an interference with medicaid operations. He says the state is also under obligated by the constitution to adhere to any contracts it has including Planned Parenthood of Indiana.

State Senator Scott Schneider, author of the new law, says Planned Parenthood has its future in its own hands, and can restore funding by no longer performing abortions at its facilities.

A U.S. district court is scheduled to hear the case June 6th.
