A federal judge has set a sentencing hearing date for Tim Durham. He‘s the Indianapolis businessman convicted of bilking five thousand investors out of more than $200 million. Sentencing is set for November 30th at 9 a.m. in US District Court in Indianapolis.
Durham and partners Jim Cochran and Rick Snow remain in federal custody.
Durham‘s attorney John Tompkins is preparing for the sentencing hearing. Tompkins says November 30th will be a tough day as he fights for leniency for Durham.
“There are numerous issues in how the facts played out, what actually occurred at Fair Finance,” he says. “How to characterize the nature and extent of the losses.”
The jury found Durham guilty on all twelve counts of conspiracy to commit fraud, wire fraud and securities fraud. They found Jim Cochran guilty on eight of the counts and Rick Snow guilty on five of the counts.
Following the hearing, Judge Jane Magnus-Stinson will determine sentencing for the trio. Durham faces life behind bars.
